SCOPE OF APPLICATION

    • We are committed to safeguarding the privacy of our website visitors, service users, individual customers and customer personnel.
    • This policy applies where we are acting as a data controller with respect to the personal data of such persons; in other words, where we determine the purposes and means of the processing of that personal data.
    • We use cookies on our website. Insofar as those cookies are not strictly necessary for the provision of our website and services, we will ask you to consent to our use of cookies when you first visit our website.
    • In this policy, “we”, “us” and “our” refer to SAS Doplr . For more information about us, see Section 14.

 

OFFER AND CONCLUSION OF THE CONTRACT

    • The presentation of the products in the online shop only represents an invitation to order and does not constitute a binding legally offer.
    • The products descriptions on our Website are only approximate and product images are for illustrative purposes only. While we make every effort to be as accurate as possible on our Website regarding products descriptions (including, without limitation, size, weight, capacity and dimensions) and to display the most accurate colours, any description is only approximate and we cannot guarantee that the colours displayed on our site reflect the exact colour of the products.
    • By clicking on the order button, the Customer undertakes to purchase all products listed on the order page.
    • All orders are subject to acceptance by Doplr Watch . Orders are considered as accepted once Doplr Watch  communicates them to the shipment company.
      For permanent collection products, orders may only be canceled by the customers for a full refund within 10 hours of placing the order. For pre-order products, orders may only be canceled for a full refund until the end of the pre-order period. For limited edition products, cancellations are not permitted.
    • All products presented on our website are subject to availability. If the product you have ordered is not available, we will inform you by e-mail as soon as possible and Doplr Watch  will offer you (i) to secure payment for shipment for the next available batch, if any, or (ii) to be notified once the watch is back in stock.
    • Online sales via the Website are intended for end consumers of the products, not for resellers. Doplr Watch  may at its sole discretion refuse an order if they suspect the purchaser is acquiring the products for resale.
    • Customers shall comply with all applicable rules. If the customer is subject to sale restrictions due to governmental measures regarding some sales products presented on the Website, he/she commits to not order it. Doplr Watch  reserves the right to refuse the order if they have any doubt. The customer agrees to have Doplr Watch  using the personal data provided by the customer in the process of the Order to carry out appropriate sale due diligence.
    • The customers are responsible for providing accurate and correct personal information for delivery and sale. All changes must be sent to support@furlanmarri.com. For direct order product, the customer delivery information (shipping address, contact information) can no longer be updated 10 hours after ordering. For pre-order products, the customer delivery information (shipping address, contact information) can only be updated until the end of the pre-order period. After this period, as we use an automatic fulfilment center, the item will be processed for picked, packed and delivered.

 

PAYMENT PRICES AND TERMS

    • The prices will be in EUROS. These prices are exclusive of tax for exports and VAT, except for european union residents while ordering “swiss made mechanical watches (Three Hands Story as an example)” for which the VAT will be added and paid at the time of the order. The customer is responsible for the customs import duties, VAT or any related taxes applicable in his country, and should be aware before purchasing (European Union customers included, Switzerland is not part of the European Union). We ship our watches either from France. Local duties and VAT are due upon the delivery of our watches and this will depends on your country (Switzerland is not part of the European Union). It’s a normal process that e-commerce brands have, as they don’t have boutiques to include or charge local taxes. For example, India can be up to 48% and Switzerland 8,1%. USA have a treshold of USD 800. If the customer don’t want to pay the taxes, the product will be returned to us and we will have to deduct those fees from the refund, as local government taxes cannot be refunded. Please make sure of your decision before refusing to pay government taxes an duties, as sometimes it can be more appropriate to keep the product.. Depending on the country the Website is visited from, the currency may be different. However, payments will always be made in EURO. Price differences may appear on the product page and the invoice, according to the exchange rate of the day. However, we will still charge in EUROS €
    • Doplr Watch  reserves the right to change their prices at any given time. The prices charged to customers are the prices that are published on the site on the days of the order.
    • The payment can be made either by debit card, credit card and Apple Pay.
    • The payment shall be made upon order. If, for any reason, the payment is refused, the order will be automatically cancelled.

 

DELIVERY TERMS AND CONDITIONS

    • In general, the delivery time is between 5 to 15 days, unless otherwise specified in the offer. Watches are shipped through Express service while accessories are shipped through Economic service. The delivery time is given as an estimation only and is not binding. Depending on the country of delivery, it may take more time due in particular to customs inspections. Doplr Watch  will not be liable for any delay due to an extension of the delivery deadline.
    • Doplr Watch  offers free shipping for orders starting from EUROS 1350€.
    • All products will be shipped worldwide, with insurance and tracking references. We are not responsible for any import permit fees and/or other fees that couriers may add.
    • In the event some of the ordered products are not available, Doplr Watch  is entitled to make partial deliveries.
    • In the event the product could not be delivered due to the customer’s fault, Doplr Watch  is entitled to withdraw from the contract after two delivery attempts. In this case, any payments made will be refunded, subject to deduction of delivery costs and any others costs Doplr Watch  had to bear in connection with the return of the product.
    • In the event the product could not be delivered due to the customer non-payment of customs fees, permit fees due to the remote or out of town area or if customs refuse the product for whatever reason, Doplr Watch  is entitled to withdraw from the contract. Any payments made will be refunded, subject to deduction of delivery costs and all others costs Doplr Watch  had to bear in connection with for the return of the product.
    • Some shipping restrictions may occur with regard to certain national regulations. Before ordering, the customer shall make sure that there are no shipping restrictions in his/her country, considering that watches are shipped from France. Doplr Watch  is not liable for any delivery problem due to national restrictions. If delivery is made impossible due to national restrictions, the order will be cancelled. The price will be refunded subject to deduction of delivery and any other fees. Doplr Watch  does not deliver to P.O. boxes and such orders can be cancelled (some couriers cannot deliver to P.O. Boxes).
    • Due to shipping carriers restrictions area, some destinations are not covered, therefore we are not able to ship our products in those specific areas. You can access the full list of restricted countries by UPS or DHL Express
    • There are some restrictions also for Ukraine and Russia, our shipping carriers cannot currently ship our goods there. Additionally, we are unable to deliver to Montenegro at this time.

 

TRANSFER OF PROPERTY

The product remains Doplr Watch ’s property until it has been fully paid for and delivered to the customer. Pledging, assignment by way of security, transformation or modification shall not take place prior to Doplr Watch ’s transfer of ownership and without Doplr Watch ’s consent.

 

RIGHT OF WITHDRAWAL

    • Customers have the right to withdraw from the contract within 14 days following receipt of the products. The withdrawal right apply exclusively for the permanent collection. The withdrawal declaration must be notified in writing via Doplr Watch ’s e-mail address. The dispatch date of the withdrawal declaration is relevant for compliance with the deadline. It is not necessary to state the reasons for cancellation. The withdrawal declaration must be sent to: doplr.watch(airbase)gmail.com
    • The withdrawal right is exercised in such a way that the sales contract is transformed into a cancellation, with the return of the services received under the contract. The customer is obliged to return the received product to Doplr Watch  in the original packaging, the protective sticker on the glass of the watch must still be present, together with all supplied accessories (including straps, accessories, packaging, certificate of origin and all other papers), without any trace of use, and within 14 days from the withdrawal declaration to Doplr Watch .
    • Personal engraving can’t be return
    • Regarding the accessories sold separately, they must be returned in their original packaging, including the straps with the original stickers on the buckle.The returning costs of the watch are to be supported by the customer. Without all these conditions, the product has no resale value for a new customer.
    • You must use a trackable shipping service and purchase shipping insurance. If you do not use a tracking service and purchase a shipping insurance and that the product is lost, Doplr Watch  will not refund you.
    • Once paid, the purchase price shall be immediately refunded to the customer, less the return costs upon receipt and inspection of the products, subject to a deduction from the price to be refunded in case of damage to the product or excessive wear and tear. Doplr Watch  has the right to hold the refund until the product has been returned or until the customer provides proof that the goods have been returned, whichever comes first.
    • Withdrawal rights are not applicable to pre-order and limited edition watches. This exception is due to the fact that limited editions are only sold for a specific period of time and cannot be sold again after a potential return. Pre-orders limited by time cannot be refund after the pre-order selling period, due to the fact that Doplr Watch  produces the watches with the funds received.

 

WARRANTY AND LIABILITY

    • Doplr Watch  guarantees that the products comply with the promised qualities, are free from defects that may affect their value or fitness for purpose and that they correspond to the intended performance and specifications.
    • Doplr Watch  provides the customer with a warranty against manufacturing defects or hidden defects within 2 years as from the date of delivery of the product. Any claim for manufacturing defects or hidden defects must be submitted within 48 hours from the date of delivery of the Products or, in case of hidden defects, from their discovery.     • A manufacturing defect and/or a hidden defect notified in the above mentioned delay shall allow for the replacement or reparation of the defective product or a refund of the paid price, at Doplr Watch ’s sole discretion, by Doplr Watch  and at Doplr Watch ’s costs (except the shipping cost of the defective product to Doplr Watch  which shall be at the customer’s cost).
      The customer must then return the damaged or defective product to Doplr Watch  (in its original packaging), to the address that Doplr Watch  will communicate at a later stage.
    • Doplr Watch  shall not be liable for any damage caused by a misuse of a product. Excessive shocks or vibrations, exposure to strong electromagnets and similar activities can cause damage to or affect the functions. If you are uncertain if a particular activity is safe for the watch, please e-mail us at Doplr.watch(arobase)gmail.com.
    • You must use a trackable shipping service and purchase shipping insurance. If the product is lost, due to the fact that you do not use a tracking service and do not purchase a shipping insurance, Doplr Watch  will not refund you.
    • The warranty does not include straps and accessories.

 

DISCLAIMER

Despite all the care taken in preparing the Website, it may contain inaccurate or incomplete information. Doplr Watch  is not responsible for any errors or omissions in the images or descriptions of the products on the Website. Doplr Watch  shall not be liable for any direct or indirect damage resulting from interruptions of the Website, from the occurrence of bugs hindering the navigation of the Website or from any other technical problems (including the possible presence of viruses or other harmful elements). Doplr Watch  accepts no responsibility for the content of third-party websites that may be accessible from the Website or linking to their Website by means of hyperlinks. Doplr Watch  has no control over the content of these external sites.

 

FORCE MAJEURE

Doplr Watch  shall not be liable for failure to execute an order due to force majeure. Force majeure is any circumstance beyond the control of Doplr Watch , including, but not limited to, major business disruptions, accidents, labour disputes, late or defective deliveries of raw materials or semi- or fully manufactured products, restrictions imposed by the authorities, epidemics, pandemics, fires, floods or other natural disasters.

When you create a customer account on the Website, you are asked to provide us with information about yourself, such as your name, email address, billing address, delivery address and payment details. You agree to provide us with accurate and complete information. You also send us personal data when you send us a message via the contact form available on the Website or by email. INTELLECTUAL PROPERTY

Doplr Watch  brand is a protected trademark and cannot be used and reproduced without Doplr Watch ’s express written consent. The content and structure of the products displayed by Doplr Watch , as well as the entire internet offers, are protected by copyright. The use of articles and work tools for personal use by the customer is permitted, however their commercial distribution in part or whole requires the express permission of Doplr Watch.

 

PLACE OF JURISDICTION AND APPLICABLE LAW

The contractual relationship between the customer and Doplr Watch  is subject to Swiss substantive laws, excluding the provisions of the United Nations Convention of 11 April 1980 on the International Sale of Goods. The competent court of Geneva is competent for all disputes arising from this contract.

 

FINAL PROVISIONS

Should individual provisions of these general terms and conditions be ineffective, the validity of the remaining provisions shall not be affected.
